Court rejects El-Rufai’s bail variation request as DSS closes case

The Federal High Court has dismissed an application seeking to vary the bail conditions of former Kaduna State Governor, Nasir El-Rufai, in the alleged illegal wiretapping case.

Justice Joyce Abdulmalik ruled that the existing stringent bail conditions will remain in force. The conditions require sureties who are Level 17 civil servants with properties in Maitama or Asokoro, as well as attestation letters from the Kaduna State Traditional Council. The court held that qualified sureties are still available to meet these requirements.

At the resumed hearing, the Department of State Services (DSS) formally closed its case against El-Rufai, confirming that it would not call any further witnesses.

Counsel to the defendant, Paul Erokoro, informed the court of plans to file a “no-case submission,” arguing that the prosecution had failed to establish sufficient evidence linking his client to the allegations.

The court adjourned the matter until September 22, 2026, for hearing of the no-case submission and continuation of proceedings.
